Protesting without French nationality

Key points

  • Peaceful protest is a right for everyone.
  • An arrest does not automatically lead to losing your permit or to an OQTF (removal order).
  • Carry a copy of your permit and the number of La Cimade or an immigration lawyer.
  • In custody: same rights, interpreter, consulate; appeals against an OQTF have very short deadlines.

Peaceful protest is a right for everyone, whatever their nationality.1 But an arrest can have extra consequences for your residence status: know them before you go.

Risks to know

  • Peaceful participation alone does not cost you a residence permit. However, facts considered a threat to public order can be taken into account by the prefecture at renewal or naturalisation.2
  • A removal order (OQTF) requires a separate administrative decision: an arrest does not trigger it automatically.2
  • Without a valid permit, you can be held to check your right of residence, a supervised, time-limited measure.3

Before the protest

  • Carry a copy of your residence permit or receipt (keep the original safe if you fear losing it).
  • Write down the number of a legal team and of La Cimade or an immigration lawyer.
  • If your situation is fragile (no permit, ongoing procedure), choose a less exposed part of the march and leave before dispersal (dispersal and warnings).

If you are arrested

  • You have the same rights as everyone in custody: lawyer, doctor, interpreter, silence.4
  • You can ask for your country's consular authorities to be notified.4
  • Don't sign any document you don't understand; ask for the interpreter.
  • If you receive a prefecture decision (refusal of residence, OQTF), appeal deadlines are very short: contact a lawyer, La Cimade or GISTI immediately.25
